Context/Observation

Part IV Section 16 (6) of the Procurement Act 2007 requires that companies eligible for contract award should possess the necessary professional and technical qualifications, financial capability, equipment and other relevant infrastructure etc. During the scrutiny of records and documents, it was observed that contracts for the reconstruction and renovation of classrooms totaling ₦569,758,938.00 (Five hundred and sixty nine million, seven hundred and fifty eight thousand, nine hundred and thirty eight naira) were awarded to contractors whose businesses do not align with the contract activity described on the contract award letters.
This practice is against the principles of fairness and transparency built into the procurement act, and casts doubt on the contract award procedure adopted by the Board.
