Audit observed that three (3) payments totalling ₦25,000,000,000.00 were transferred from independent revenue accounts, to finance Capital Development without passing through the Consolidated Revenue Funds from which withdrawals are only allowed through appropriations as required by Section 80(2) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) which states that, “No moneys shall be withdrawn from the Consolidated Revenue Fund of the Federation except to meet expenditure that is charged upon the fund by this Constitution…” Furthermore, the purpose for which the amount under reference was moved was not stated neither was there any evidence to support the authorization of the amount through appropriation contrary to the provisions of FR 301.
The Accountant-General of the Federation is requested to:
i. Justify the non compliance with the provisions of FR 301 and Section 80(2) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), and
ii. Provide Justification for ₦25,000,000,000.00 unappropriated transfer from the Revenue Accounts to finance Capital Development.
iii. Otherwise, the above expenditure totaling ₦25,000,000,000.00 is disallowed (FR 417) and consequently, the Officers should be held pecuniary responsible (FR 301).
