Context/Observation

I.The contract for the dualization of Ahoada – Omoku Road: Phase 1, Rehabilitation of Ahoada – Omoku – Okwuzi Road in River State was awarded to th a contractor on the 10 of November, 2010 at a contract sum of N5,117,920,728.75
II.The contractor was given an Engineer’s Order, in accordance with clause 41 of the standard conditions of contract to commence work on 13 of December, 2010 and complete same on or before 12 of June, 2012.
III.The Ministry has not recovered the sum of N776,688,109.32 which represent the unrecovered advance granted for the project from the contractor.
IV.The sum of N1,192,523,564.46 had been certified and paid to the contractor for work done so far. This amount was considered reasonable to have fully paid back the advance payment.
V.Physical inspection of the project site in February 2020 revealed that the contractor demobilized from the project site since 2012 and NDDC had since taken over the construction of the road.
VI.Rivers State Controller of Works recommended that the project should be terminated but the Ministry was yet to take any action.

Legislative Recommendation

The Permanent Secretary is requested to:
I. Furnish reasons why advance payment made to the contractor was not backed by required unconditional advance payment bank guarantee in accordance with extant regulations.
II. Recover and remit the sum of N776,688,109.32 to the Treasury.
III. Forward evidence of remittance to the Public Accounts Committees of the National Assembly
IV.Otherwise, sanctions relating to payment for job not executed in paragraph 3104(i) of the Financial Regulations will apply.
