Context/Observation

I.The contract for the rehabilitation of Agbor – Sakpoba – Ogharafe Road Section III with spur to Ewuru(4Km) in Delta State was awarded to a contractor on the 29 of October, 2012 at a contract sum of N848,061,742.50
II.The contractor was given an Engineer’s Order, in accordance with clause 41 of the standard conditions of the contract to commence work on 15 of January, 2013 with a completion date of 14 July, 2014.
III.Advance payment of the sum of N121,151,677.51 of which the sum of N36,386,887.15 was recovered from Interim Payment Certificates (IPC) generated, leaving an outstanding of N84,765,790.15
IV.The sum of N369,401,110.16 had been certified and paid to the contractor for work done. This amount was considered reasonable to have fully paid back the advance payment.
V.Physical inspection of the project site in February 2020 revealed that the contractor demobilized from the project site since 2019.
VI.On the 8 of May 2019, the Contractor demobilised from site, complaining of the inability to obtain approvals for upward review of the contract sum and the extension of the completion period for a job that ought to have been completed on14 July, 2014, and
VII.The immediate past Federal Controller of Works, Edo State recommended the termination of the contract through letter Ref. No. HW/ED/6/5930/Vol II/133 dated 15 June 2020. This decision was already overdue.

Legislative Recommendation

The Permanent Secretary is requested to:
I.Furnish reasons why advance payment made to the contractor was not backed by required unconditional advance payment bank guarantee in accordance with extant regulations.
II.Recover and remit the sum of N84,765,790.15 to the Treasury.
III.Forward evidence of remittance to the Public Accounts Committees of the National Assembly
IV.Otherwise, sanctions relating to payment for job not executed in paragraph 3104(i) of the Financial Regulations will apply.
