Audit established the council’s non- compliance to the provisions of section 4 (2f) of the agency’s edict which states that a secretary of council shall be appointed by the head of service on the recommendation of the managing director, from any of the ministries that have a presence on the board. This is predicated on the fact that the executive director of the agency who is the secretary of the council is neither from any other ministry in the state nor from any of the ministries that have representatives in the board as stated in the above section.
The managing director was by this requested to pursue with immediate effect, the amendment of the above section and any other section that are no longer consistent with what is obtainable in the agency from the state house of assembly. Otherwise the office of the executive director which is alien to law establishing the agency should be suspended and secretary appointed in its place in accordance with the law.
