Context/Observation

It is recommended by the Auditor General for the Federation that:
(i) The outstanding 5% retention of N158,177,841.77 due to the contractor should not be paid.
(ii) The total sum of N131,811,567.62 identified as payment for work not done should be recovered from the contractor’s outstanding retention of N158,177,841.77 failing which the amount should be recovered from the Dir/PMS together with all officers that signed the payment certificates for this contractor to be paid.
(iii) The undeducted 5% VAT of N72,413,897.81 due to the Federal Government and the FIRS not deducted from the total mobilization advance of N1,148,277,956.17 (N57,413,897.81) paid to the contractor between 2005 and 2009 and fast tracking amount of N300,000,000.00 paid to the contractor in February 2012 (N15,000,000.00) should also be recovered from the contractor, failing which the
amount should be recovered from the NDDC Director of Finance.
Evidence of the recovery should be forwarded to the Office of the Auditor General for the Federation for verification.
